What Do Buyers Check Before Paying a Token?

They check the title first. A serious buyer, and their bank if they’re taking a loan, will want the full chain of registered sale deeds, the freehold or leasehold status and the mutation. These four questions come up on almost every property sale in Janakpuri.

I go through the file with you before any buyer visits, because a gap found by the buyer’s lawyer late in the deal is a common reason a sale stalls.

You can sell a leasehold property, but converting to freehold first usually makes the sale easier. Many buyers, and their banks, prefer a freehold title with a registered conveyance deed. Conversion goes through DDA, and it won’t go through while there is a title dispute or a pending mutation. In August 2026 DDA paused conversions for a policy review, and on 28 September 2026 the Delhi High Court directed it to clear the pending applications within two months, so check where your application stands. If conversion isn’t possible in time, I’ll tell you how a leasehold sale works and what the buyer will ask for.

Not safely as it stands. Since the Supreme Court’s 2011 judgment in Suraj Lamp and Industries v. State of Haryana, a GPA, agreement to sell or will does not transfer ownership; only a registered sale deed does. If your own purchase was on a GPA, a careful buyer’s lawyer will stop the deal there. The gap has to be closed before you can sell, usually by getting a registered deed executed for the earlier transfer. It’s worth doing even if you’re not selling yet, because the problem only gets harder as years pass. Call me and I’ll tell you what your papers need.

First get the property into the heirs’ names. That means the papers showing how it passed to you, such as a will or the legal heirs’ documents, and the DDA mutation in your names. If there are several heirs, every co-owner must either sign the sale deed or give up their share through a registered relinquishment deed before the sale. Buyers’ lawyers check this closely, because one missing signature can cloud the title for years. Sort the family paperwork before you look for a buyer; I can tell you what’s needed in your case and in what order.

Yes, if the floors are owned separately. Builder floors in Janakpuri are usually sold floor by floor, each on its own registered sale deed with a share of the land. If you own the whole house and want to sell one floor, the sale deed has to define that floor and its share of the land, roof and parking clearly, and the building should match its sanctioned plan. Buyers and banks look hard at how the floor is described. Tell me how your property is held and I’ll tell you whether a floor-wise sale works for you.

Two things to know. On almost every Janakpuri sale the buyer deducts 1% TDS from the price and deposits it against your PAN; you claim it back in your tax return. Separately, the gain on the sale is taxed. If you’ve held the property for more than two years it is a long-term gain, and reinvesting in another home or in approved bonds can reduce the tax. The rules have changed in recent years, so plan this with your CA before you agree the deal. I’ll make sure the sale paperwork shows the figures your CA needs.

It depends on what you need from the property. Selling gives you money now. A builder collaboration usually leaves you with one or more new floors, built at the builder’s cost, in exchange for the others, so it suits owners who want to stay or want floors for family. It takes longer, and it depends on the builder’s track record and a registered agreement with clear terms. The buyer, unless the agreement says otherwise. In Delhi the buyer pays stamp duty on the sale deed at 6% for a man, 4% for a woman and 5% for a man and woman in joint names, plus a 1% registration fee, worked out on the deal value or the circle rate, whichever is higher. As the seller you sign the sale deed at the sub-registrar’s office, hand over the original papers and the keys, and receive the balance payment. Make sure the agreement to sell spells out who pays what, so there is no argument on registry day.

Yes. An NRI owner can sell in person or through someone in India holding a proper Power of Attorney. A Power of Attorney signed abroad has to be attested at the Indian embassy or consulate and then stamped in Delhi within three months of arriving, so give yourself time. The buyer deducts a higher TDS for an NRI seller than for a resident, so plan the tax with your CA in advance, along with how the money will be sent abroad.
